The Xylem entity that is the responsible entity (also referred to as data controller, handler, or business) for the processing of your personal information depends on the individual circumstances of the processing.

  • Site Interactions: The Xylem entity that is identified on the Site as responsible entity / site operator is the responsible entity for the processing of your personal information in the context of Site Interactions. Recruitment:

If we offer you a job, we may collect additional background information, such as credit history and eligibility information (as permitted by law);
  • Job Applicant Sensitive Information (where permitted and in accordance with applicable law): Some of the information identified above may qualify as sensitive information under applicable law, in particular social security number and driver’s license number. HOW XYLEM DISCLOSES YOUR PERSONAL INFORMATION

We may disclose the personal information listed above in the following situations to recipients, as permitted by applicable law:

  • Xylem affiliates. We may disclose your personal information or details of your use of the Sites to our affiliates (e.g., parent company, sister companies or subsidiaries, and other companies under common control).

Xylem provides suitable safeguards for cross-border transfers to address as required by law. In particular, we typically rely on the European Union Standard Contractual Clauses (“EU SCCs”), and the United Kingdom Addendum to the EU SCCs for such cross-border transfers to the United States and other third countries where required by law. YOUR RIGHTS AND CHOICES

You may have certain rights regarding your personal information. Your rights will vary depending on the laws that apply to you and your personal information. Specifically, you may have the following rights:

Depending on the purposes of the processing, you may have the right to have incomplete personal information completed, including by means of providing a supplementary statement. As noted above, you may also be able to correct your personal information in your account or profile.
  • Deletion (erasure): Right to request that we delete your personal information. If required by law, we will grant your request to delete information. However, when we delete personal information, it will be removed from our active database, but it may remain in archives where it is not practical or possible to delete it. Making personal information (such as online/device identifiers, browsing activity, or geolocation) available to social media platforms and ad networks to deliver interest-based ads to you may be a “sharing” under California law (in this context “sharing” means cross contextual behavioral advertising).   • Commercially Recognized Opt-Out Signal: Xylem generally recognizes commercially recognized opt-out preference signals (e.g., Global Privacy Controls, Do Not Track). HOW XYLEM RETAINS YOUR PERSONAL INFORMATION?

We retain personal information about you and your use of our services and Sites for as long as is needed to fulfill our legitimate business purposes outlined in this Privacy Statement. The specific periods for which we keep information about you vary depending on the nature of the information, why we need it, and whether the personal information is de-identified. We also consider the minimum necessary retention period prescribed by applicable laws, recommended by industry standards, and stated in contracts and other legal obligations.

HOW XYLEM PROTECTS THE SECURITY OF YOUR INFORMATION?

Xylem uses industry-standard encryption technologies when transferring and receiving data exchanged with our Sites. We have appropriate security measures in place in our physical facilities designed to protect against loss, misuse, or alteration of information that we have collected from you on our Sites. Legal basis for Processing Your Personal Information

The legal basis for processing your personal information will be only either your consent, or as otherwise provided for under PRC’s Personal Information Protection Law.

How Xylem Stores, Transfers, and Processes Your Personal Information Across Borders

As Xylem is a group of companies operating globally, for the purposes mentioned under this Privacy Statement, your personal information or the personal information of your employees or representatives may be transferred out of PRC, and stored and processed in the relevant locations, including, without limitation, where Xylem Inc. is based and/or where Xylem Inc.’s applicable service providers’ data centers are located if such service providers are engaged by Xylem Inc. to store and process the relevant personal information on its behalf.

The foreign recipient in this instance will be Xylem Inc. in the United States with its address at 301 Water Street SE, Suite 200, Washington, DC, 20003 and contact e-mail data.privacy@xylem.com.

Where the relevant personal information is transferred outside of PRC, such information will be transferred by the responsible Xylem entity in the PRC uploading the relevant information to the information management software or operational systems globally deployed by Xylem Inc. (or its service providers) outside of PRC, and/or providing Xylem Inc. (or its authorised persons) access to the local PRC data centers storing such information.

You may contact Xylem at the contact details set forth in the section “Contact Us” if you want to exercise your rights against the foreign recipient, and the applicable Xylem entity (i.e. the data controller for your personal information) shall assist you with notifying the foreign recipient of your request and supervise the protection of your rights.

Where so required by PRC Personal Information Protection Law, we shall conduct personal information assessments and/or enter into applicable contractual terms with the foreign recipient with respect to such cross-border transfers.  

By continuing to proceed such interactions with us as set forth in the “RESPONSIBLE ENTITY” section, you are deemed to have consented to this Privacy Statement and the processing activities for your personal information as contemplated hereunder, including, without limitation, the cross-border transfers of your relevant personal information, and where you have provided us with the personal information of your employees or representative, you are deemed to have, prior to provision of such personal information to us,

Xylem maintains Sites on social media platforms (such as Facebook and Instagram) ("Social Media Site" or "Social Media Sites"). If you visit such a Social Media Site, Xylem has no control over the type of Tracking Technology used on such social media platform. The operators of the social media platforms use Tracking Technology on such Social Media Sites to collect user information and create general statistics about the interests and demographic characteristics (e.g., age, gender, region) of the Social Media Site visitors. The nature, scope and purposes of the use of your personal information in this context are determined by the operator of the social media platform. TRACKING TECHNOLOGY USED ON SITES

Xylem uses certain types of Tracking Technology on its Sites that are not Social Media Sites (for Social Media Sites see above. Such Tracking Technology include typical cookies, but also web beacons, clear GIF, pixels, internet tags, web server logs, scripts, and other data collection tools. Tracking Technology collects information about you automatically when you visit our Sites. Tracking Technology may also be used by Xylem in certain promotional emails to track when you open or click on such emails and how you engage with those emails.

PURPOSES FOR USE OF TRACKING TECHNOLOGY

Tracking Technology is used for various purposes, in particular for strictly necessary purposes as well as performance, functional, targeting and social media purposes. Further information on each purpose is set out in the cookie preference center.

Depending on the applicable laws, Tracking Technology for performance, functional, targeting, and social media purposes may require your opt-in consent or are subject to your right to opt-out.

Where opt-in consent is not required, the use of Tracking Technology is permitted because such Tracking Technology is required to perform or to enter into a contract with you or to pursue our legitimate business interests (such as offering a functioning and secure Site to you).
